Appeals Court Grants Climate United Petition for Rehearing
December 17, 2025

Washington D.C. (December 17, 2025) — Today, the U.S. District Court of Appeals granted Climate United’s petition for rehearing en banc, allowing the court to reconsider a previous 2-1 Appeals panel ruling in favor of the Environmental Protection Agency’s abrupt funding freeze earlier this year. The rehearing on February 24, 2026, will enable the full court to weigh in on our case in the coming months.

“Everyone deserves access to financing for clean energy projects that create good jobs, reduce pollution, and lower energy bills,” said Climate United CEO Beth Bafford. “For over nine months, EPA’s unlawful actions have prevented us from delivering clean, affordable energy to hardworking Americans across the country. We will continue to press forward on behalf of the communities we serve, and we look forward to the court’s reconsideration of our case so we can get back to work.”
